§ 18 Honorary Council

The internal honorary council is appointed based on the rules of procedure for the implementation of honorary council procedures to arbitrate all disputes arising from the association relationship, through disciplinary notifications as well as legal remedies for the exclusion of association members in (§ 6 para. It is an arbitration body within the meaning of the Association Act 2002 and not an arbitration tribunal according to §§ 577 ZPO.

  1. The honorary council consists of three members and three substitute members, who are elected by the general assembly for a term of office of three years; its members may not belong to any body - with the exception of the general assembly.
  2. The honorary council elects a chairman and a deputy from among its members with a majority of votes.
  3. The honorary council has a quorum when all members are present.
  4. The Honorary Council makes all its decisions with a simple majority of votes. Abstention is not permitted.
  5. The honorary council decides, after granting a mutual hearing, without being bound by certain forms, to the best of its knowledge and belief.
  6. Resolutions of the honorary council are final within the association.
  7. A protocol must be kept of the honorary council procedure, which must be signed by all members of the honorary council and the original must be handed over to the president of the club.
  8. The decision of the honorary council must be sent to the person concerned in writing.
  9. It is left to the Honorary Council to summon witnesses or examine evidence in the course of any evidence proceedings.
  10. Each party to the dispute has to pay for the expenses of the witnesses presented by him and for the costs of his evidence.
  11. The honorary council decides in a private meeting or a private negotiation and has to justify its decisions in writing. The decisions of the Honorary Council are final. The recourse to the ordinary courts is not permitted.
